Biography

OLAV's grandmother, RAGNHILD TARJEISDOTTER owned Nape, Sitje and Øverland, as allodial property, and paid tax on them in 1603 and again in 1611. Shortly after that RAGNHILD died and the farms passed on to Signe Tarjeisdotter, who was the daughter of OLAV's uncle.

When Signe died the land passed to Signe's mother Gunhild. According to the law of succession, the land passed to Signe's mother because Signe had no children herself, had no siblings, and her father was deceased.

In 1624, OLAV TARJEISON Brekke (of Nissedal) and his brother Knut, filed suit to regain the Nape farm. They argued that they had the allodial rights. The farm belonged to their grandmother RAGNHILD and should have been passed down to their mother GJERTRUD and then to them (since their own sisters were deceased and had no heirs). The petition was denied. The court ruled that Gunhild would have the use of the farm the rest of her life, and then the heirs of RAGNHILD would regain the allodial rights.

The name [Sitje] was called unique by Rygh's "Norske Gaardnavne" ["Norwegian Farm Names"] without him being able to interpret it with certainty. It probably has a connection with "to sit".

Brørne Olav Brekke og Knut Sitje finn me i 1624 i sak om arven etter Ragnhild Nape. Dei meinte mor deira var nærast til den ettersom dottera til Tarjei Nape var død utan born. Etter arveloven fann retten at enkja Gunhild Nape skulle ha Nape så lenge ho levde. Stemninga vann ikkje fram.

 
English translation

We find the brothers Olav Brekke og Knut Sitje in 1624 in a lawsuit about the inheritance after Ragnhild Nape died. They believed their mother was first in line to it [the inheritance] inasmuch as the daughters of Tarjei Nape were deceased without children. After the law of succession the court found that the widow Gunhild Nape would have Nape as long as she lived. The petition was denied.

Frå nokre arvetvistar utpå 1600talet høyrer me om Såvi og Ragnhild på Nape. Dei åtte mellom anna 3 tnK i Sitje med Lie. Såvi døydde tidleg, men me finn Ragnhild fleire gonger. I eit brev frå 1588(?) skreiv ho seg for Sitje og vitna då om øydegarden Lie. Versonen Folke hadde leigd han i år. Det skulle difor vere visst at det var Folke Tjodgeirson frå Straume som var den fyrste brukaren me finn i skattelistene. Ei tid etter at han flytte heim til Hylestad, finn me den andre versonen til Ragnhild.

Det var Tarjei Folkeson frå S.Rygnestad som var gift med Gjertrud Såvisdtr. Ragnhild på Nape åtte 1 tnK i Sitje i 1603, men budde truleg på Sitje alt då. Eit brev frå 1605 fortel at Ragnhild Tarjeisdtr hadde budd med versonen Tarjei Folkeson nokre år. Borna til sonen var umyndige. Tarjei skulle få alt ho hadde i lause pengar og landskylda av dei 4 tnK ho åtte for levetida hennar mot å gje føderåd.

Tarjei døydde truleg ikring 1610. Etter det finn me ei rekkje namn på garden, truleg var det borna og borneborna hans. Frå det me får høyre i tvisten om Nape og andre stader, må det ha vore mange born. Eigarar i 1615 var Olav Svalestog med 5 mK og Torkjell Lindem i Nesherad med 2½ tnK.

Gjertrud var framleis i live i 1624. Ho åtte då 2 tnK i Sitje som kjøpegods, 1 mK i Bergland som odel og 1 mK i Austad i Nednes som giftegods. Olav Svalestog hadde 5 mK giftegods. Truleg døydde Gjertrud ikring 1630 og må då ha vore ei gamal kvinne.

 
English translation

From several inherited residences well into the 1600's we hear about Såvi and Ragnhild of Nape. They owned among other things 3 tnK at Sitje including Lie. Såvi died early, but we find Ragnhild several times. She wrote in support of Sitje in a 1588(?) document and then testified about the allodial farm Lie. Her son-in-law Folke had leased it for 9 years. It should therefore be certain that it was Folke Tjodgeirson from Straume who was the first owner we find in the skattelistene [tax rolls]. Some time after he moved home to Hylestad, we find the other son-in-law [Tarjei Folkeson] of Ragnhild.

Tarjei Folkeson from S.Rygnestad was married to Gjertrud Såvisdtr. Ragnhild of Nape had 1 tnK at Sitje in 1603, but probably already lived at Sitje then. A document from 1605 tells that Ragnhild Tarjeisdtr had lived with her son-in-law Tarjei Folkeson several years. The children of her son were minors. Tarjei would get all she had in payments due and land rents of the 4 tnK she had for her lifetime in return for bestowing her pension.

Tarjei probably died around 1610. After that we find a line of names at the farm, probably his children and grandchildren. From that we hear in the dispute about Nape and other places, there may have been many children. Owners in 1615 were Olav Svalestog with 5 mK and Torkjell Lindem of Nesherad with 2½ tnK.

Gjertrud was still alive in 1624. She had then 2 tnK at Sitje as property, 1 mK at Bergland as allodial property and 1 mK at Austad in Nednes [Aust-Agder] as marital property. Olav Svalestog had 5 mK marital property. Gjertrud probably died around 1630 and must have then been an old woman.
